In May 2016, new regulations, known as the Tobacco and Related Products Regulations (TRPR), were implemented in the UK, affecting the sale and promotion of e-cigarettes. The EU’s Tobacco Products Directive (TPD) applies similar legislation to tobacco and nicotine-containing products in the European Union.

The UK’s Tobacco and Related Products Regulations (TRPR) are part of the EU’s Tobacco Products Directive (TPD) and cover everything from how tobacco and nicotine products are made to how they’re advertised. This includes vapes and e-cigarettes, which contain nicotine.

The TPD regulations were introduced to ensure the safety and quality of e-cigarettes, providing vapers with greater certainty regarding the products they buy. According to the European Commission, the TPD aims to ‘improve the functioning of the internal market for tobacco and related products’.

These regulations brought about many changes to e-cigarettes, including establishing a maximum size for e-liquid bottles and tanks. The appearance of packaging will also change, with health warnings and ingredient lists required.

Article 20 of the Tobacco Product Directive covers e-cigarettes and nicotine-containing e-liquids regulations. The TPD regulations include:

• ‘minimum standards for the safety and quality of all e-cigarettes and refill containers;
• that information is provided to consumers so that they can make informed choices;
• an environment that protects children from starting to use these products.’

The TPD (an EU legislation) does not include regulations around smoke-free environments, advertising or sales, age restrictions, nicotine-free cigarettes or the flavourings of e-cigarettes. These are regulated domestically (by the UK, Northern Ireland and Scotland).
